Background

Cessnock City Council is seeking community feedback on a Planning Proposal aimed at making minor administrative amendments to the Cessnock Local Environmental Plan 2011 (CLEP). These updates are designed to address minor anomalies and improve planning and land use outcomes across the Local Government Area (LGA).


What Are the Proposed Amendments?

  1. Reintroducing "Storage Premises" in the E4 General Industrial Zone

    • Inadvertently removed during the employment zone reforms, the "storage premises" land use will be reinstated in the E4 General Industrial zone to support better planning outcomes.
  2. Correcting a Zoning Anomaly on Hospital Road, Weston

    • A parcel of crown land at Weston (Lot 328 DP: 755231) is currently zoned RU2 Rural Landscape but is surrounded by C2 Environmental Conservation land and including the Kurri Kurri Cemetery. The proposal will rezone this parcel to C2 Environmental Conservation to align with its current use as vacant bushland.
  3. Removing Minimum Lot Size (MLS) Controls in Weston Town Centre

    • To ensure consistency across the LGA, the proposal will remove MLS controls from all areas zoned MU1 Mixed Use and E1 Local Centre in Weston Town Centre.
  4. Minor Wording Amendment to Clause 4.1E

    • Clause 4.1E of CLEP 2011, which governs subdivision requirements for unsewered land, will be updated to clarify the wording. The change will specify that allotments must be "not less than 4000m²" rather than "4000m²."

Why Are These Changes Being Made?

These amendments aim to:

  • Address technical errors and inconsistencies in the CLEP.
  • Enhance land use flexibility and alignment with current and intended uses.
  • Improve the clarity and functionality of planning controls.
