At the council meeting on 20 September 2023, Council resolved to adopt the draft Development Control Plan (DCP) Chapter – Regrowth Kurri Kurri.

The new Chapter applies to the land known as Regrowth Kurri Kurri and includes the site previously occupied by the Kurri Kurri Hydro Aluminum Smelter. The Chapter contains area-based land-use controls to guide the design, conservation and management of development.

Background - site and project history


After closing the operations of Kurri Kurri Hydro Aluminum Smelter, the landowner started investigating redevelopment opportunities for the former Smelter land and surrounding land in Loxford, Cliftleigh and Gillieston Heights within the Cessnock and Maitland Local Government Areas (LGA).


Separate proposals for land within their respective LGA were to be prepared. A Planning Proposal was prepared for the land (Hydro Kurri Kurri) within the Cessnock LGA, wherein, part of the land was rezoned by amending the Cessnock Local Environmental Plan 2011 (CLEP 2011) to permit employment, industrial and residential development. The rezoning of land within the Cessnock LGA occurred on 16 December 2022.


In addition, the land was declared an Urban Release Area (URA) by including it in the Urban Release Areas maps associated with the CLEP 2011. As such, a site-specific DCP is required under the provision of clause 6.3 of the CLEP 2011. This was also anticipated during the assessment of the Planning Proposal for the land that future development will be guided and controlled by a site-specific development control chapter in the Cessnock Development Control Plan 2010 (DCP 2010).


Council is seeking feedback regarding the development controls for future subdivision and development of Hydro Kurri Kurri.


The draft Chapter E20 - Hydro Kurri Kurri of the DCP 2010 (Draft Hydro DCP) at Enclosure 1 has been prepared to meet these requirements and is now on public exhibition for community comment.
